Usedemart is an online retail platform that directly sells used, refurbished, pre-owned, reconditioned, surplus and other products/materials to customers.

Usedemart may sell products through its website, mobile applications or other digital channels.

These Terms & Conditions (“Terms”) govern your access to and use of the Platform and your purchase of products from Usedemart.

By accessing, registering on, or purchasing products through Usedemart, you agree to these Terms and the other policies published on the Platform.

You must be legally capable of entering into a binding contract under applicable Indian law to purchase products from Usedemart.

By placing an order, you confirm that the information provided by you is accurate and complete.

Usedemart directly sells products that may be:

The condition of each product will be indicated on the relevant product page wherever reasonably possible.

Used and refurbished products may show signs of previous use.

Depending on the product, this may include:

• Scratches;
• Minor dents;
• Cosmetic marks;
• Wear and tear;
• Replaced components;

• Missing original accessories, where disclosed.

We make reasonable efforts to ensure that product descriptions, photographs, specifications and prices are accurate.

• Actual colour may vary depending on the customer's display;
• Photographs may not show every minor cosmetic mark;
• Product specifications may vary by model or configuration;
• Used/refurbished products may have individual variations.

If there is a material error in product information, Usedemart may take appropriate corrective action, including cancellation of an order where permitted by law.

All products are subject to availability.

A product displayed on the Platform may become unavailable before an order is confirmed.

If an ordered product becomes unavailable, we may cancel the order and provide an applicable refund.

Product prices will be displayed on the Platform.

Where applicable, the price will identify applicable taxes and other mandatory charges. Additional delivery, handling or other charges, if applicable, will be disclosed before order confirmation.

Usedemart reserves the right to correct pricing errors. If an order has been placed at an obviously incorrect price due to a technical or human error, Usedemart may cancel the order and refund any amount already paid, subject to applicable law.

You may place an order by following the ordering process provided on the Platform.

Before completing an order, you should verify:

Usedemart reserves the right to accept or decline an order.

An order may be cancelled where:

You agree to provide accurate payment and billing information.

Usedemart does not ordinarily store complete payment-card information unless required and permitted under applicable law and security standards.

Products will be delivered to the address provided by the customer, subject to service availability.

Customers must:

• Provide accurate information;
• Provide a correct delivery address;
• Inspect the product where reasonably possible;
• Use the product appropriately;
• Follow applicable instructions;
• Maintain account security;
• Not misuse the Platform.

If you purchase a used or refurbished electronic device, you should check that the device has been properly reset before use.

Usedemart is not responsible for personal information left on a device by a customer after return, to the extent permitted by law.

You must not:

• Use the Platform for unlawful purposes;
• Attempt unauthorised access;
• Introduce malware or malicious code;
• Interfere with Platform security;
• Create fraudulent accounts;
• Provide false information;
• Conduct fraudulent transactions;
• Abuse promotional offers;
• Scrape or copy Platform content without permission.

The Usedemart name, logo, website design, software, content, graphics, photographs, text and other Platform materials are owned by or licensed to Usedemart unless otherwise stated.

You may not reproduce, modify, distribute or commercially exploit such material without prior written permission.

Customers may provide reviews, ratings or feedback where the Platform permits.

Reviews must be genuine and must not contain:

• False information;
• Abusive content;
• Threats;
• Personal information of another person;
• Malicious software;
• Unlawful or infringing material.

Usedemart may remove content that violates applicable policies or law.

We use reasonable technical and organisational measures to protect our Platform and information.

However, no online system can be guaranteed to be completely secure.

To the maximum extent permitted by applicable law, Usedemart shall not be liable for indirect or consequential losses arising from use of the Platform.

Nothing in these Terms excludes or limits any liability or consumer right that cannot legally be excluded or limited.

Usedemart may suspend or terminate an account where reasonably necessary due to:

• Fraud;
• Misuse;
• Security concerns;
• Violation of these Terms;
• Unlawful activity; or
• Other circumstances permitted by law.

We may update these Terms from time to time.

The updated version will be published on the Platform with a revised effective date.

These Terms shall be governed by the laws of India.

Nothing in these Terms restricts any mandatory rights or remedies available to consumers under applicable law.

Subject to applicable law, disputes may be subject to the jurisdiction of courts at Pune.
